1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts between 99 Stays GmbH, Birkenstraße 2, 35041 Marburg, Germany (hereinafter referred to as the “Landlord”), and the tenant concerning the rental of furnished holiday apartments or serviced apartments for short-term use on a daily, weekly, or monthly basis. For bookings made via external booking platforms (e.g., Airbnb, Booking.com, etc.), the respective terms and policies of those platforms shall also apply. In the event of any discrepancies, the platform’s regulations take precedence.
2. Subject Matter of the Contract
The subject of the contract is the temporary rental of fully equipped holiday apartments and serviced apartments for private use by the tenant. Commercial or any other type of use requires the express consent of the landlord.
3. Booking and Conclusion of Contract
Bookings can be made directly via the 99 Stays GmbH website, by e-mail, or through third-party platforms. A binding contract is concluded upon written booking confirmation by the landlord. Upon receipt of the booking confirmation, the General Terms and Conditions valid at the time of booking are deemed accepted.
4. Prices and Payment Terms
All prices are final prices and include statutory VAT as well as all ancillary costs (water, electricity, heating, internet), unless otherwise stated. Payment must generally be made in advance. Accepted payment methods are bank transfer and PayPal. If the invoice is not paid in full no later than 24 hours before arrival, the landlord reserves the right to cancel the booking. In such cases, the full accommodation price (excluding the cleaning fee) remains payable.
5. Cancellation Policy (for Direct Bookings)
Cancellations are free of charge up to 14 days before arrival. In case of later cancellation or no-show, 100% of the accommodation price will be charged. The cleaning fee will not be charged or will be refunded in case of no-show. This policy applies exclusively to direct bookings made via the website or directly with 99 Stays GmbH. For bookings via third-party platforms, the respective platform’s cancellation policies apply.
6. Check-in and Check-out
Check-in: from 3:00 p.m. Check-out: until 10:00 a.m. Early check-in or late check-out is only possible by prior arrangement and subject to an additional fee. If check-out is delayed and thereby delays cleaning, the resulting costs will be charged to the tenant.
7. Use of the Accommodation
Pets are generally not permitted. Exceptions apply only to the apartments “Hillside” and “Snowflake,” provided this has been agreed upon in advance. Smoking is not permitted inside the apartments or in any common areas (e.g., hallways). Smoking is allowed on the balcony, if available. In case of violation of the non-smoking policy inside the apartment, a special cleaning fee of €200 plus additional cleaning costs will be charged.
8. House Rules / Conduct
The following regulations form part of the house rules and are deemed accepted upon booking: The tenant is liable for all damages or losses caused to the accommodation or its inventory during the stay. Any damages or losses must be reported to the landlord immediately and compensated accordingly. The number of guests may not exceed the number stated in the booking. Unauthorized additional guests will incur an extra fee of €30 per person per night. The loss of keys or access cards must be reported immediately. The tenant bears the costs for replacement keys, lock changes, or locksmith services. If the key is left inside the apartment and access is no longer possible, the tenant shall bear the locksmith costs. Cleaning costs resulting from late check-out or special cleaning (e.g., after pet stay, smoking, or excessive dirt) will be charged to the tenant.
9. Liability
99 Stays GmbH is liable only for damages resulting from intentional or grossly negligent breaches of duty. No liability is assumed for the loss or damage of the tenant’s personal belongings. Temporary interruptions in infrastructure (electricity, internet, water, etc.) do not entitle the tenant to a rent reduction or contract termination.
10. Data Protection
The processing of personal data is carried out in accordance with the privacy policy published on the website.
11. Final Provisions
German law applies. The place of jurisdiction for all disputes, to the extent legally permissible, is the registered office of 99 Stays GmbH. If any provision of these GTC is or becomes invalid in whole or in part, the validity of the remaining provisions shall not be affected.
